Terms of Use

These terms apply when you visit hashtaq.com or contact us through it. They cover the website itself. They are not the contract for a campaign - that is a separate agreement, see section 3.

1. Who runs this site

hashtaq.com is operated by Hashtag Marketing GmbH, Bergstrasse 44a, 6010 Kriens, Switzerland. Full company details are in the Imprint. Where these terms say "we," "us," or "our," they mean Hashtag Marketing GmbH and the Hashtaq brand it operates.

2. What these terms cover

They cover this website and the pages under hashtaq.com, including the German and Swiss versions of the site. By using the site you accept them. If you do not accept them, please do not use the site.

3. No campaign is sold here

Nothing on this site is a binding offer, and sending us a form or an email does not create a contract. Pricing, packages, reach figures and examples on the site are information, not terms.

When we work together on a campaign, the scope, price, deliverables and any guarantee are set out in a separate written agreement between you and Hashtag Marketing GmbH. That agreement governs the work. If anything in it differs from this page, the agreement applies.

4. Using the site

You may read the site, share links to it, and contact us through it. Please do not:

• Interfere with the site or try to gain access to parts of it that are not public
• Scrape, copy or re-publish substantial parts of it, or use it to train a model, without our written permission
• Use our forms to send unsolicited advertising, malware, or anyone else's personal data without their knowledge
• Use the site in a way that breaks the law where you are

5. Forms and the information you send us

When you submit a contact or creator form, you confirm that what you enter is accurate and that you are entitled to share it. We use it to answer you; how we handle it is described in the Privacy Policy. Please do not send confidential material through a web form.

6. Our content

The texts, images, videos, logos and the design of this site are protected and belong to us or to the people we license them from. You may not reuse them commercially without our written permission. The Hashtaq name and mark are ours.

Campaign examples shown on the site were produced with the businesses and creators named alongside them, and are shown with their agreement.

7. Third-party names and links

Company names, logos and trademarks that appear on this site belong to their owners and are shown to identify work we have done or platforms we work with. Their appearance does not imply that they endorse us.

Where we link to other sites, we do not control what is on them and are not responsible for their content or their privacy practices.

8. Availability

We try to keep the site available, but we do not promise that it is uninterrupted or error-free. We may change, suspend or discontinue any part of it at any time.

9. No warranty on the information

The site is provided as it is. Figures, examples and descriptions are given in good faith and reflect our experience at the time of publication. They are not a promise of a particular result for you. Anything we guarantee for a specific campaign is what stands in the agreement for that campaign, not on this page.

10. Liability

We are liable without limitation for intent and gross negligence, and where liability cannot be excluded by law. Beyond that, our liability for the use of this website is excluded as far as the law allows. Nothing here limits any liability agreed in a separate campaign agreement.

11. Privacy

How we handle personal information is set out in the Privacy Policy. U.S. residents can also read the California Consumer Privacy Notice, opt out via Do Not Sell or Share, and see who processes data on our behalf under Sub-processors.

12. Changes to these terms

We may update this page. The version that applies is the one published here when you use the site; the date at the top tells you when it last changed.

13. Governing law

Swiss law applies. The place of jurisdiction is Lucerne, Switzerland. Where mandatory consumer protection law in your country of residence gives you rights that cannot be set aside by agreement, those rights remain unaffected.
